Social Media, Funeral & Personal Property - Who Has Permission?

How organized are you? Have you updated or completed a will, Trust, medical or financial powers of attorney? If so, great!  Now is the time to take the next step and address those issues that are part of dying, just a little less formal perhaps. For example, have you made funeral/burial arrangements? Does your family know what you want?  Do they agree with your wishes?  If not, should you consider appointing a completely separate funeral representative to carry out your wishes?

What about your social media sites? Does anyone have your password information?  Would they be able to shut down your Twitter page, your Face Book page or even a business LinkedIn page?  Many, if not all, of the social media sites have rules regarding who can shut these sites down legally. Don’t just assume that your executor or trustee will have that authority. Put it in writing.

How about your personal property? Do you have a list of items you want to go to a specific person?  Do you live in assisted living, an apartment or even a nursing home?  Does anyone at the facility know who has the authority to come in and remove your items at death? Will the facility find themselves in the middle of a family battle?

Estate planning means planning for life and for death and making sure those that you leave behind have a clear understanding of what your wishes are and who is in charge of what.
